Customer Terms

Our Role: platform/introducer; not provider of services.

Use: 18+, accurate info, supervise children where required.

Bookings: confirmed via platform/email/vendor.

Payments: Mumly Pay / vendor direct / third-party; Mumly does not store full card data.

Refunds: per vendor policy; Mumly may intervene for non-delivery/safety/misleading conduct.

Safety & Child Protection: vendors are independent; parents assess suitability; report concerns: support@mumly.co.uk.

Travel: introducer only; see Travel Disclaimer.

Health/Beauty: results vary; patch tests where required.

Reviews: honest and respectful.

Prohibited: abuse, fraud, fee-bypass, illegal use.

Liability: limited; not liable for vendor services, travel disruptions, employment decisions, treatment reactions.

Suspension, Changes, Law: E&W jurisdiction.

Vendor Terms

  1. Introduction

These Vendor Terms & Conditions (“Vendor Terms”) apply to all Vendors who list services, offers, courses, events,

or products on the Mumly Platform operated by Mumly Careers Ltd. By creating a Vendor account, you agree to comply

with these Terms, the Mumly Terms of Use, and all applicable UK laws.

 

  1. Vendor Eligibility

2.1 Vendors must be legally registered businesses or sole traders.

2.2 Vendors must have authority to enter into commercial agreements.

2.3 Vendors must provide accurate business information at all times.

 

  1. Vendor Accounts

3.1 Vendors must keep their account information accurate and updated.

3.2 Mumly may request verification documents at any time.

3.3 Vendors are responsible for their account security and activity carried out under it.

 

  1. Listings, Content & Advertising

4.1 Vendors must ensure all listings are:

– accurate, lawful, and up to date;

– non-misleading;

– compliant with UK consumer and advertising laws.

 

4.2 Prohibited content includes:

– misleading claims;

– adult content;

– unsafe or illegal services;

– discriminatory or harmful content.

 

4.3 Mumly may edit, refuse, or remove listings that violate standards.

 

  1. Vendor Responsibilities

Vendors must:

– deliver services as described;

– maintain professional conduct;

– comply with UK safety, safeguarding, and child protection laws;

– ensure staff working with children hold appropriate DBS checks.

 

 

 

  1. Commission & Fees

6.1 Vendor fees and commission rates are outlined in the Mumly Vendor Pricing Schedule.

6.2 Mumly reserves the right to update commission with notice.

6.3 Vendors are responsible for applicable taxes.

 

  1. Payments

7.1 Payments may be processed through third‑party providers.

7.2 Mumly is not responsible for payment delays outside its control.

 

  1. Customer Interactions

8.1 Vendors must provide a safe, respectful experience to all Mumly users.

8.2 Complaints must be addressed promptly.

8.3 Mumly may intervene where safeguarding concerns arise.

 

  1. Intellectual Property

9.1 Vendors retain rights to their own branding and materials.

9.2 Vendors grant Mumly a licence to use logos, images, and descriptions for promotional purposes.

 

  1. Prohibited Vendor Conduct

Vendors must not:

– bypass the Platform to avoid commission;

– harvest Mumly user data;

– scrape or copy Platform content;

– impersonate other businesses;

– engage in fraud or misconduct.

 

 

  1. Suspension & Termination

Mumly may suspend or terminate Vendors for:

– repeated policy violations;

– safeguarding concerns;

– fraud or illegal behaviour;

– reputational or legal risks to Mumly.

 

  1. Liability & Indemnity

12.1 Vendors operate independently; Mumly is not liable for Vendor services.

12.2 Vendors indemnify Mumly against claims arising from:

– service delivery;

– negligence;

– breach of law;

– breach of these Terms.

 

  1. Data Protection

13.1 Vendors must comply with UK GDPR.

13.2 Vendors must not misuse Mumly user data.

13.3 All data issues must be reported to support@mumly.co.uk.

 

  1. Governing Law

These Terms are governed by the laws of England and Wales.

Eligibility: 18+, legitimate business, licences/insurance, safeguarding compliance.

Listings: accurate descriptions, pricing, images, availability; keep updated.

Obligations: skill/care, honour bookings, insurance, DBS where applicable, prompt replies, confidentiality, lawful conduct.

Customer Data (GDPR): independent controller; use only to fulfil bookings; no marketing without consent; secure handling; delete when no longer needed; breaches reported within 24h.

Commissions & Fees: per booking/listing/subscription/feature/transaction; fee avoidance may result in removal.

Payments: Mumly Pay (payouts) or vendor-direct (invoiced commission).

Cancellations/Refunds: clear policy; follow UK consumer law; Mumly may refund in exceptional cases.

Conduct: no harassment, fake reviews, last-minute cancels without reason, unsafe practices, crypto schemes.

Insurance/Qualifications: vendor responsibility.

Liability & Indemnity: vendor indemnifies Mumly for claims from their services.

IP: licence to display and promote listings.

Reviews: no manipulation.

Suspension/Termination: breaches, safety concerns, unpaid fees.

Marketplace Vendor & Product Seller Agreement

1.Introduction

Mumly Careers Ltd (“Mumly”) operates an online hybrid marketplace connecting families with vendors offering services and physical products. This Agreement governs all Vendors who: (a) list services, (b) sell products, (c) accept bookings, or (d) receive referrals through the Mumly Platform.

2. Definitions

Vendor: Any individual or business offering services or products through Mumly.

Customer: A Mumly user purchasing a service or product.

Hybrid Model: Includes referral-only, marketplace listing, and booking intermediary models.

Booking Intermediary: Mumly may process payments on behalf of Vendors.

Services: Activities, childcare, clubs, coaching, beauty, cleaning, or similar.

Products: Physical goods including children’s items, wellness products, party supplies, etc.

3. Vendor Eligibility & Onboarding

Vendors must submit accurate registration information, verify identity, comply with UK law, and provide documents if required (insurance, DBS, licences, product certifications).

4. Vendor Obligations

Vendors must: provide accurate descriptions, maintain high quality, comply with legal standards, respond promptly to customers, fulfil orders, attend bookings, and treat customers professionally.

5. Service Providers (Additional Requirements)

Vendors offering childcare, tutoring, clubs, mentoring, wellness or similar must:

– Hold appropriate DBS checks

– Follow UK safeguarding law

– Provide qualification proof where applicable

6. Product Sellers (Additional Requirements)

Products must comply with UK consumer law, including:

– Safety certifications

– Accurate labelling

– Age-appropriate warnings

– UKCA/CE standards where required

Vendors are fully liable for product safety.

7. Fees, Commission & Payment

Mumly may charge listing fees, commission, subscription fees or referral fees. Payment terms will be displayed in the Vendor Dashboard or via email. Vendors must provide correct payout information. Mumly may withhold payments in case of dispute, fraud, or refunds.

8. Customer Bookings

If Mumly processes bookings:

– Cancellations follow category-specific rules

– Vendors must meet booking obligations

– Failure may result in penalties or account suspension

9. Refunds & Cancellations

Vendors must comply with UK Consumer Rights Act 2015. Refund authority depends on the model:

– Referral: Vendor handles refunds

– Booking intermediary: Mumly may process refunds on Vendor’s behalf

10. Prohibited Conduct

Vendors may not:

– Misrepresent services or products

– Upload harmful content

– Harass users

– Contact users off-platform without permission

– Sell unsafe or counterfeit products

11. Insurance

Vendors offering physical services (e.g., beauty, cleaning, clubs) must hold adequate public liability insurance. Product sellers must hold product liability insurance.

12. Safeguarding & Safety

Vendors working with children must comply with Mumly’s Safeguarding Policy. Mumly may suspend vendors who pose risk.

13. Data Protection & GDPR

Both parties must comply with UK GDPR. Mumly acts as Data Controller. Vendors act as independent controllers of customer fulfilment data.

14. Intellectual Property

Vendor retains ownership of their content but grants Mumly a licence to display listings. Vendors must not infringe third-party IP.

15. Termination

Mumly may suspend or terminate vendors for breach, safety risk, fraud, poor conduct, or regulatory non-compliance. Vendors may terminate with 30-day written notice.

16. Liability

Mumly is not liable for errors made by Vendors, nor safety of venues, products, or service outcomes. Vendors indemnify Mumly for losses arising from their actions.

17. Disputes

Parties should resolve disputes amicably. If required, disputes may proceed to UK courts under English law.

Refunds & Cancellations Policy

Our Role: may process refunds if Mumly collected payment; facilitate disputes; intervene for safety/fraud.

Mumly Pay: request via account/email; assess against vendor policy; approved refunds return to original method.

Vendor-Direct: handle with vendor per their policy; Mumly may escalate for non-delivery/safety/fraud patterns.

Vendor Policies: notice periods, deposits, no-shows, weather, credits/reschedule.

Customer Cancellations: early/late/no-show/illness/change-of-mind. * (See direct Vendor Policies on vendors’ websites or below star asterisk)

Vendor Cancellations: full refund or reschedule if Mumly Pay; vendor handles it direct.

Mumly-Initiated Refunds: for non-delivery, safety, false info, fraud.

*Exclusions: change of mind; child refuses to participate; minor delays; weather (unless vendor cancels); delivered services; no-shows; force majeure.

Travel: governed by provider policy & protections.

Multi-Session: missed sessions generally non-refundable; vendor may reschedule.

Timelines: Stripe 3–10 days; PayPal 1–5 days.

Disputes & Abuse: escalation; potential suspension for misuse.

Updates apply upon publication.

Safeguarding & Child Protection Policy

Scope: clubs, camps, tutors, childcare, Kidonomy, family services, travel with children.

Principles: welfare paramount; protect from harm; everyone responsible; partner with compliant vendors; protect children’s data; no unsupervised child contact.

Mumly’s Role: marketplace/introducer, not childcare provider or employer; reporting point; facilitator of safe comms.

Vendor Requirements: legal registrations, insurance, DBS, H&S, supervision ratios; no direct contact with children; no photos without consent; report concerns; records.

Parents: due diligence; provide accurate info; supervise where required; safe drop/collection; emergency contacts; report concerns to support@mumly.co.uk.

Children’s Data: parental consent; no profiling/ads; delete when done; restricted access; ICO code compliance.

Comms: parent-to-vendor only; no private comms with minors.

Reporting: immediate risk call 999; concerns to support@mumly.co.uk. Mumly logs, investigates, escalates to authorities; may suspend vendors.

Vetting: declarations, remove non-compliant vendors. Parents should request DBS/policies/quals.

Safer Recruitment (vendors): DBS, references, ID, training.

Online Safety: no child accounts; messaging rules; no child photos without consent; remove harmful content.

Staff Training: safeguarding + GDPR awareness.

Review: annual or upon law change.
